These Terms of Service (the "Terms") govern your access to and use of the Wellstry website, online store, products, content, features, and related services (collectively, the "Services"). By visiting the website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and the policies referenced below.
Please read these Terms carefully. If you do not agree, you should not use the Services.
1. About Wellstry and Shopify
Wellstry operates this store and offers professional nail equipment and accessories to salon professionals, businesses, and individual customers. Our online store is hosted by Shopify, which provides the ecommerce platform used to offer the Services and process transactions.
2. Eligibility and Accounts
You must have the legal capacity to enter into a binding agreement in your country or region to use the Services or place an order. If you permit a minor to use a device or account under your supervision, you are responsible for that use to the extent permitted by law.
You agree to provide accurate, current, and complete account, billing, shipping, customs, and contact information. You are responsible for safeguarding your account credentials and for activity performed through your account. Notify us promptly if you believe your account has been accessed without authorization.
3. Products and Product Information
We make reasonable efforts to present product descriptions, specifications, colors, images, availability, and pricing accurately. Screen settings, photography, production updates, and normal manufacturing tolerances may cause minor differences in appearance.
Product information may be corrected or updated without notice. We may discontinue products, limit quantities, or restrict sales to particular customers, regions, or jurisdictions where reasonably necessary or required by law.
4. Orders and Acceptance
Submitting an order is an offer to purchase. An order is accepted only after Wellstry confirms acceptance and payment is successfully processed. We may reject, limit, hold, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, payment issues, legal restrictions, export controls, or inaccurate customer information.
If we cancel an order after payment has been received, we will refund the applicable amount to the original payment method.
5. Prices, Payments, Taxes, and Import Charges
Prices, discounts, and promotions may change without notice. The price charged is the price displayed or quoted when the order is submitted, subject to correction of clear errors before acceptance.
Unless expressly stated otherwise, prices do not include shipping charges, customs duties, import taxes, brokerage fees, bank charges, or other local costs. Customers are responsible for applicable import charges unless Wellstry agrees otherwise in writing.
6. Shipping and Delivery
Most orders are normally prepared and dispatched within approximately 7 days after payment confirmation. Available methods may include DHL and other major international express couriers or sea freight, depending on the destination, shipment size, weight, and required delivery speed.
Delivery estimates are not guaranteed and may be affected by customs, carriers, weather, local operations, or other circumstances outside our reasonable control. Full details are available in our Shipping Policy, which forms part of these Terms.
7. Returns, Refunds, and Cancellations
Eligible return requests must be submitted within 7 calendar days after delivery. Conditions, exclusions, return shipping responsibility, damaged or incorrect item procedures, cancellation terms, and refund timing are explained in our Refund Policy, which forms part of these Terms.
8. One-Year Product Warranty
Wellstry products include a one-year warranty against manufacturing defects beginning from the date of delivery. The warranty is separate from the 7-day return period and does not cover normal wear, consumable parts, accidental damage, misuse, unauthorized repair or modification, improper voltage or charging, or failure to follow product instructions.
Warranty claims require proof of purchase and sufficient photos, video, or other information to evaluate the issue. Depending on the circumstances, Wellstry may provide troubleshooting, repair, replacement parts, replacement, or another appropriate warranty solution.
9. Professional Use and Safety
You are responsible for selecting products appropriate for your experience, intended application, electrical supply, and local safety requirements. Read and follow all product instructions, warnings, maintenance guidance, and applicable professional standards.
Electric nail drills, lamps, dust collectors, bits, and related tools must be used carefully and only for their intended purpose. Stop using a product if it appears damaged, overheats abnormally, or operates unexpectedly, and contact us for support.
10. Wholesale, Customized, and OEM/ODM Orders
Wholesale, private-label, customized, and OEM/ODM projects may be governed by a separate quotation, invoice, specification sheet, sample approval, production schedule, or written agreement. If those project-specific terms conflict with these Terms, the project-specific written terms will control for that order.
11. Acceptable Use
You may not use the Services to violate any law, infringe intellectual property or privacy rights, submit false or misleading information, transmit malicious code, interfere with website security, scrape or exploit the Services without authorization, impersonate another person, or engage in fraud or abusive conduct.
We may suspend or terminate access to the Services when reasonably necessary to protect customers, Wellstry, Shopify, service providers, or the integrity of the website.
12. Intellectual Property
The Wellstry name, website design, product photography, text, graphics, videos, logos, product materials, and other content are owned by or licensed to Wellstry and are protected by applicable intellectual property laws. You may use the website for personal or legitimate business purchasing purposes but may not copy, reproduce, modify, distribute, sell, or commercially exploit protected content without prior written permission.
13. Third-Party Services and Links
The Services may rely on or link to third-party providers, including Shopify, payment processors, carriers, analytics providers, and external websites. Third-party services are governed by their own terms and policies. Wellstry is not responsible for third-party content or conduct beyond the extent required by applicable law.
14. Privacy
Our collection and use of personal information are described in the Privacy Policy. Shopify may also process information as described in its own applicable privacy notices.
15. Disclaimers
To the maximum extent permitted by law, the Services are provided on an "as available" basis. We do not guarantee that website access will always be uninterrupted, secure, or error-free. Product warranties are limited to the express warranty stated in these Terms and any additional rights that cannot legally be excluded.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot be excluded under applicable law.
16. Limitation of Liability
To the maximum extent permitted by law, Wellstry will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products, including lost profits, lost business, or lost data.
Where liability cannot be excluded, Wellstry's liability will be limited only to the extent permitted by applicable law. These limitations do not apply where prohibited, including liability that cannot legally be limited for fraud, willful misconduct, death, personal injury, or mandatory consumer protections.
17. Indemnification
To the extent permitted by law, you agree to compensate Wellstry for reasonable losses, claims, or expenses arising from your unlawful misuse of the Services, infringement of another person's rights, or material breach of these Terms. This provision does not apply where prohibited by consumer law.
18. Severability and No Waiver
If part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
19. Governing Principles and Consumer Rights
These Terms are governed by the laws applicable to the operator of Wellstry and the transaction, without limiting any mandatory rights or protections available to consumers in their country or region. Any dispute should first be submitted to us so that both parties can attempt to resolve it in good faith.
20. Changes to These Terms
We may update these Terms when our Services, business practices, or legal obligations change. The latest version will be published on this page with an updated date. Changes apply prospectively unless applicable law requires otherwise.
